It was a revelation to me, as I watched my supervisor interacting with our clients and I realized that legal interviewing needs to be approached from a different angle as compared to other interviews.*4 The fact-finding mission that this entails often meets with subtle resistance from clients and especially poses a challenge when dealing with clients who are not familiar with English since there is a possibilit y for distortions during translation.*5 Such clients are often unaware that client privilege is their fundamental civil right as established by the Courts*6 and they are reluctant to be completely honest with their lawyers. But this was not the only area where I discovered that practice is different from theory. While law school provided me with the background of the law, actual practice concerns the application of the law. Earlier, my understanding of the law was directed towards its mechanics, whereas I obtained a clearer perspective of the law that conditions a lawyer’s actions during my placement experience. As Bernie Marden puts it, professions today operate in a world where â€Å"public policy applies regulation, co-regulation, and self-regulation in varying degrees†*7 and this is why it was deemed necessary to introduce the Professional Standards Act of 1994 in Australia.  Ã‚

Most of the fatalities are linked to accidents caused when 15-inch ATX and Wilderness tires mounted on Ford Explorers experienced tread separation, usually in hot weather. Bridgestone/Firestone Inc. has recalled 6.5 million of those tires, and the NHTSA has issued a consumer advisory covering an additional 1.4 million Firestone tires. On August 9 of this year, Firestone, owned by Japan’s Bridgestone Corporation, began recalling 6.5 million tires made up of a certain 15-inch models of its ATX and Wilderness AT tires in response to a federal probe that began in May. The majority of the recalled tires were fitted over a decade to Ford motor company’s best selling sport utility vehicle, the Explorer. Firestone claims that the unique design of the 235/75R15 Wilderness AT tire, in combination with variations in the manufacturing process at its Deatur, Illinois, plant may have produced some of the problems. At the Senate hearing, Ford and Firestone again blamed each other for the problem, which has strained an automotive partnership that goes back 100 years. A Reuters Zogby poll released last week showed that three out of five people surveyed in the United States blamed Firestone for the controversy, while only one in fifteen blamed Ford. Remembering the Murder of Shanda Sharer Few crimes in modern times caused more public horror than the grisly torture and murder of 12-year-old Shanda Sharer at the hands of four teenage girls on Jan. 11, 1992 in Madison, Indiana. The callousness and brutality exhibited by the four teenage girls, ages 15 to 17, shocked the public then, and it continues to be a source of fascination and revulsion as the subject of dozens of books, magazine articles, television programs, and psychiatric papers.   The Events Leading to the Murder At the time of her murder, Shanda Renee Sharer was the 12-year old daughter of divorced parents, attending school at  Our  Lady of Perpetual Help Catholic school in New Albany, Indiana, after transferring the previous year from Hazelwood Middle School. While at Hazelwood, Shanda had met Amanda Heavrin. Initially the two girls fought, but eventually became friends and then became entered into a youthful romance.   In October of 1991, Amanda and Shanda were attending a school dance together when they were angrily confronted by Melinda Loveless, an older girl that Amanda Heavrin had also been dating since 1990. As Shanda Sharer and Amanda Heavrin continued to socialize through October, the jealous Melinda Loveless began to discuss killing Shanda and was observed threatening her in public. It was at this point, concerned about their daughters safety, that Shandas parents transferred her to a Catholic school and away from Amanda. The Abduction, Torture, and Murder Despite the fact that Shanda Sharer was no longer in the same school as Amanda Heavrin, Melinda Loveless jealousy continued to fester over the next few months, and on the night of Jan. 10, 1992, Melinda, along with three friends- Toni Lawrence (age 15), Hope Rippey (age 15), and Laurie Tackett (age 17)- drove to where Shanda was spending the weekend with her father. Just after midnight, the older girls convinced Shanda that her friend Amanda Heavrin was waiting for her at a teenage hangout spot known as the Witchs Castle, a ruined stone home in a remote area overlooking the Ohio River. Once in the car, Melinda Loveless began to threaten Shanda with a knife, and once they arrived at Witchs Castle, the threats escalated into an hours-long torture session. It was the details of the savagery that followed, all of which came out later in testimony from one of the girls, that so horrified the public. Over a period of more than six hours, Shanda Sharer was subject to beatings with fists, strangling with a rope, repeated stabbings, and battery and sodomy with a tire iron. Finally, the still living girl was doused with gasoline and set ablaze in the early morning hours of Jan. 11, 1992, in a field alongside a gravel county road.   Immediately after the murder, the four girls had breakfast at McDonalds, where it is reported that they laughingly compared the look of the sausage to that of the corpse they had just abandoned.   The Investigation Uncovering the truth of this crime thankfully did not take long. Shanda Sharers body was discovered later that same morning by hunters driving along the road. When Shandas parents reported her missing in early afternoon, the connection to the discovered body was quickly suspected. That evening, a distraught Toni Lawrence accompanied by her parents arrived at the  Jefferson County Sheriffs office  and began to confess the details of the crime. Dental records quickly confirmed that the remains discovered by the hunters were those of Shanda Sharer. By the next day, all the involved girls had been arrested.   The Criminal Proceedings With compelling evidence provided by Toni Lawrences testimony, the four girls involved were all charged as adults. With a strong likelihood of death penalty sentences, they all accepted guilty pleas in order to avoid such an outcome.   In preparation for sentencing, defense attorneys spent considerable effort assembling arguments of mitigating circumstances for some of the girls, arguing that these facts reduced their culpability. These facts were presented to the judge during the sentencing hearing. Melinda Loveless, the ringleader, had by far the most extensive history of abuse. At the legal hearing, two of her sisters and two cousins testified that her father, Larry Loveless, had forced them to have sex with him, although they could not testify that Melinda, too, had been so abused. His history of physical abuse to his wife and children was well documented, as well as a pattern of sexual misconduct. (Later, Larry Loveless would be charged with 11 counts of child sex abuse.) Laurie Tackett was raised in a strictly religious household where rock music, movies and most other trappings of normal teenage life were strictly forbidden. In rebellion, she shaved her head and engaged in occult practices. It was not entirely surprising to others that she could have participated in such a crime.   Toni Lawrence and Hope Rippey had no such troubled reputations, and experts and public onlookers were somewhat baffled at how relatively normal girls could have participated in such a crime. In the end, it was chalked up to simple peer pressure and a thirst for acceptance, but the case continues to be a source of analysis and discussion to this day.   The Sentences In exchange for her extensive testimony, Toni Lawrence received the lightest sentence- she pleaded guilty to one count of Criminal Confinement and was sentenced to a maximum of 20 years. She was released on December 14, 2000, after serving nine years. She remained on parole until December, 2002. Hope Rippey was sentenced to 60 years, with ten years suspended for mitigating circumstances. Upon later appeal, her sentence was reduced to 35 years. She was released early on April 28, 2002 from Indiana Womens Prison after serving 14 years of her original sentence.   Melinda Loveless and Laurie Tackett were sentenced to 60 years in the Indiana Womens Prison in Indianapolis. Tacket was released on Jan. 11, 2018, exactly 26 years to the day after the murder.   Melinda Loveless, the ringleader of one of the most brutal murders in recent time, is due to be released in 2019.

From Poverty to Powerhouse: Michael Oher’s Story Michael Oher was from an all-black neighborhood located in the third poorest zip code in the country. By the time he was a sophomore, he’d been to 11 different schools, he couldn’t read or write, and he had a GPA of 0.6. In his first-grade year alone, he missed 41 days of school and ended up repeating both the first and the second grade; he didn’t even go to the third grade. Oher was one of the thousands of children that have been identified as having four or more of the at-risk factors mentioned by the National Center of Education and Statistics (NCES). According to the NCES, poverty and race are high on the list of things that negatively affect students’ ability to succeed at school. Other risk factors include changing schools multiple times and being held back from one or more grades. Oher’s biography, The Blind Side by Michael Lewis, proves how socioeconomic status impacts a child’s academic success because placed in perspective, educati on is not as important as the hardships of reality. Before explaining how The Blind Side depicted the effects of socioeconomic status on Michael Oher’s education, it is important to make clear what it means to â€Å"prove.† According to Oxford Dictionaries, â€Å"prove† means â€Å"to demonstrate one’s abilities or courage† (â€Å"Prove† 1.5). The Merriam Webster Dictionary gave other definitions including â€Å"to show that (someone or something) has a particular quality or ability (â€Å"Prove† 1); â€Å"to test the worth or quality of, specifically: to compare against a standard† (â€Å"Prove† 2b), and â€Å"to show oneself to be worthy or capable of† (â€Å"Prove† 4). Nevertheless, there is evidence of ambivalence among the Native Americans to the dominant culture of the Spanish in what is arguably one of the Mexico's basic texts, the story of the Miraculous Apparition of the Virgin of Guadalupe in 1531. The Virgin of Guadalupe does not fit the usual model of the Virgin as she appears to believers, the biggest change being her native appearance. She is of the dominant culture's religion, and yet she is not. Her appearance is one of only eight worldwide that have found acceptance by the Catholic Church (Apparition 48). Moreover, she is a symbol of the native culture as well and has reverence in the eyes of both Mexicans and Mexican Americans that remains evident to date. Notably as well, Bless Me Ultima, a modern work of fiction set in New Mexico, depicts not only ambivalence toward the dominant culture of the United States, but also remnants of the same ambivalence toward the Catholic Church found hundreds of years earlier in the native culture of Mexico. A Child’s Voice as Reflected in Victorian and Romantic Poems Essay

Child labor is one of the most sensitive and controversial issues today, as it is association with child maltreatment. Nowadays, children are entitled to several rights and privileges like the rest of a country’s population, which secure and protect them from all the possible abuses and maltreatments that they may experience. Today, people’s resentment and disagreement towards child abuse and child labor can be observed in campaigns, advocacies, television programs, and other kinds of promotional advertisements. Yet, considering this, one may ask, did this societal issue exist during the medieval times, or is it a relatively young societal dilemma? If this issue indeed existed during the earlier times, how did people react to this and what did they do in order to fight this issue? In trying to address these questions, it may be very helpful to understand find out the answers within the messages of the early Victorian and Romantic poets who talked about issues like child labor during their time. The best examples of these Victorian and Romantic poems which reflect messages about child labor and abuse would be Elizabeth Barrett Browning’s The Cry of Children and William Blake’s The Chimney Sweeper. â€Å"The Cry of the Children† by Elizabeth Barrett Browning Elizabeth Barrett Browning is a Victorian poet who has been once known for her very emotional and moving poem entitled, The Cry of the Children. The Cry of the Children expresses the poet’s resentment and bitterness towards the fact that there were children of her time who were exposed to such very grueling and physically challenging tasks and jobs that can only be done efficiently by adults. The most predominant idea which covers Browning’s poem is the weeping of the distressed and miserable children. She describes in detail how painful, dark, and negative these children’s view of life has become because of the sufferings and pains they experience as they complete each day’s work. She also reveals the insensitivity and cruelty of â€Å"tyrants† who never cared about these children’s rights and privileges, as reflected in these lines: â€Å"Our blood splashes upward, O our tyrants / And your purple shews your path; / But the child’s sob curseth deeper in the silence / Than the strong man in his wrath! † (157-160). She expresses her hatred towards seeing these children weep out of exasperation and hopelessness in life. Comparing Browning’s work with that of Blake, her words appear to be more compassionate towards the feelings of abused children. Her words also sound like she is attempting to debunk everything which tolerates and allows the forceful child labor acts which put the children of the society in such a very demoralized and downgraded situation. This is also one factor which makes her work more heartrending and emotionally-moving compared to Blake’s work. ‘The Chimney Sweeper’ by William Blake The Chimney Sweeper by the Romantic poet William Blake primarily talks about the life of children who are required by their life and economic status to work as chimney sweepers. In a short and very simply-written prose, Blake reveals the feelings and perceptions of children towards an activity which adults consider as work but which they regard as their life. Comparing Blake’s work with that of Browning’s, it can be said that his poem appears to be a mere representation and reflection of the realities of these children’s lives as juvenile workers. He presents how such children consider hard-work and perseverance as the essential values they must possess in order to live. This idea can clearly be observed in these lines: â€Å"And so Tom awoke; and we rose in the dark / And got with our bags & our brushes to work. / Tho’ the morning was cold, Tom was happy and warm; / So if all do their duty they need not fear harm† (20-24). In a lot of ways, Blake’s poem does not reveal and expound much on the emotional pains and sufferings the children felt as much as how Browning’s poem does. Blake’s The Chimney Sweepers provides the impression that it only depicts what chimney sweepers do and how they feel about working hard, unlike Browning’s explicit emphasis on the maltreatment and abuse aspect of child labor. Comparing Victorian and Romantic Poems’ Sympathy on Child Labor Cause Although Browning represents the Victorian genre of literature and Blake, on the other hand, the Romantic field, the entirety of both genres cannot be judged and evaluated by looking at the works of these two poets alone. However, if the works of Browning and Blake would be used as the basis of comparison, it can be said that the Victorian genre of literature, as represented by Browning, appears to express more sympathy towards children in the issue of child labor as compared to the Romantics, as portrayed in Blake’s poetry. Also, based on the strength and dynamics of the words used, it can be observed that Browning’s stanzas are undeniably more sympathetic and compassionate towards children. Her poem also shows more concern and empathy to what children experience and go through everyday which they do not actually deserve. However, although Blake’s poem does not appear to be as much sympathetic and compassionate towards working children, it at least provides a good picture and representation of the kind of life that working children of his time led. 1.0 Introduction Working within the events sector it is highly likely that you will be faced to deal with certain risks and hazards that could occour. Risk has to be managed and can be done in a manner of ways. Some risks may be controlled by good management but others are inevitable and uncontrollable but dealing with the aftermath of uncontrollable risks can be done effectively. Guidelines and regulations are put in place to reduce risk at events but it is also down to yourself. 2.0 Bradford City Fire This disaster occoured on Sautrday 11th Mayb 1985 at Valley Parade Stadium and is still widely talked about today. A football mtch between Bradford City an d Lincolnd city took place but a great fire started resulting in 56 fatalaties and 256 injuries. 2.1 Identifying the risk The obvious risk is the fire, from the attached video in appendix you can see the start of the fire is very small and I don’t think anyone thought it would escelate to the etent that it did. The fire was first noticed at 3.40pm just 5 minutes before half time. It was noticed three rows from the back of G block in the Valley Parade ground. At first swtewards requested firefighting equipment but soon realised it was burning out of control and polie and stewards started to evacuate people from the stand. As you can see in the video it only took 4 minutes for the whole of the roof and wooden stands to become ablaze. In appendix it is reported that supporters towards the back tried to escape through the back but foun d that the gates were locked. Should the gates have been locked? And if they were why were they still loced in such an emergency? 2.2 Identifying the cause There has never been one definite cause or reason for the start of the fire but many similar reasons. The Daily Mail article in appendix reported that the cause was â€Å"a match or cigarette end dropped onto rubbish that had accumulated under the main stand at Cvalley Parade an turned the wooden structure into inferno† While an article by The Guardian suggests that litter that had developed over the years had contributed the blaze â€Å"The police officer responsible for searching the debris of the burnt-out stand told Popplewell he found litter which had been there for years, including a 1968 copy of the local newspaper† I think the cause of the fire may have been a smoke flare which encouraged the fire by the sheer negligence of not keeping the stands clean and tidy as a newspaper from 17 years prior to the event was discovered during the clean up of the disaster. A magazine article from Infochem in 2010 (issue 234) suggests the same that the fire was started by a cigarette or match and was encouraged buy built up litter but then goes on to reveal tht â€Å"Bradford City FC had been repeatedly warned about the litter posing a fire risk and had plans to upgrade their stand at the end of the season as they were to be promoted for the next season† So the fact that they had been repeatedly warned about the litter surely the stadium should have done something sooner rather than later like in this situation. 3.0 Impact of the risk It is clear from the death toll and injury numbers that many people have been affected by this , not only the mental and physical scarring of the people injured but also the families and friends of those who lost their lives that day. A report from the Independent found in appendix backs this up by describing his story of being told his father was in a special burns unit and was to have skin grafts on his hands. Also showing the severity of the outcome of the injuries a plastic surgeon Professor David Sharp and other plastic surgeons from around the UK were brought in. They operated on around 25 people in the first day while the total needing medical attention was 80. 3.1 Changes as a result of the event This may not be a direct change due to the disaster at the ground that day as this was put into practice in 2007, 22 years after the disaster but im sure it has something to do with it. Bradford City Football Club released a statement to become much more stricter on the non smoking policy. It can be found in appendix . From the introduction of the anti smoking legislation it became apparent that not all supporters were abiding by the rules and ignoring the no smokig signage in certain parts of the stadium. As suggested that a cigarette may be the main cause of the disaster you wuld of thought they would have been more forceful with this rule in the first place. They say that they feel sufficient warning have been given anf that swtard are instructed to eject anyone who is caught smoking witin the stadium. The main thing that came out of this disater was The Poppywell enquiry, this was to revise the Safety at Sports SGrounds Act 1975. From this they changed it to the Fire Safety and Safety of Places of Sport Act. One change that came out of this was to have a maximum number of attendees in stadiuns which is presently set at 10,000. This helps keep an eye on numbers and from a health and safety point of view allows the emergency services to calculate appropriate numbers for if another disaster was to happen. Also from the Poppywell enquiry came that the â€Å"Green Guide† should be revised. The Green Guide gives advice and ensures that people have a strong idea on how safety should be handles at large sporting events. 4.0 Risk strategy methodology There are 4 types of risk response strategies, these are; avoidance,reduction,retention and transference. Risk avoidance is the removal of risk liabilities or hazards. This can be done by changing certain procedures that have a high risk, removing or decreasing risk sources and substituting the less hazardous options. Sometimes risks are far too high and may not be able to be reduced at all and the only answer is to cancel or get rid of the whole idea. Risk reduction is the reduction of the severity caused by the impact. It’s done by reducing the probability of it occurring, It is basically to reduce the seriousness of the outcome should a accident occur. This is done by methods such as protecting yourselves and others and having a good security system. Risk retention is applies to small risks as the cost of insuring yourselves and others against the risk would be substantially larger than the total losses so no special efforts are made to control the risk. Later they also go with Cathy who can not bear to see her brother so. MM goes bad and Bryon calls an ambulance for him. After that Bryon discovers that Mark is dealing drugs. Mark is in prison. For example he says, ‘I bathed in the Euphrates when dawns were young’ and this gives the impression that he was around long ago when the river was just starting to form. Another quote, ‘I heard the singing of the Mississippi when Abe Lincoln went down to New Orleans’ shows a passage of time from the first quote as this historically places him in a much more modern time frame. On an unobjective level I think that this is a poem about different rivers that Hughes feels attached to for some unexplained reason. However, based on a close read ing I would argue through the explication approach that this poem can be seen in a different light. While some may argue otherwise, I believe that on an explicative level Hughes is creating a comparison between his soul and the rivers. In taking a closer look at many different aspects such as genre, my close reading interpretation, and outside research I have reached a conclusion. I have discovered that Hughes did a wonderful job of describing the slave experience as seen through his soul and the souls of all others who have experienced slavery. I believe that Hughes’ poem is oral. It seems to read as if he is passionately reciting to some fictional audience. It makes sense for his presentation to be oral as he is describing his history as well as the... ...eaks of Rivers’. This clearly demonstrates how truly important the issue of slavery was to him and how his life had become symbolized by the poem. This poem at first seemed straightforward to me. As I read it more closely and thought about it more I began to put bits and pieces together. I think Hughes has done a wonderful job of describing the slave experience, from the beginning of his narrative to the end, which is when he starts to realize that a brighter future might exist. The way it was written made me really think about what it was Hughes was trying to say. This poem made me realize that a great many people suffered as slaves. These people lived their whole lives in this capacity, most without hope of any change of status. I felt like I was putting together a jigsaw puzzle and it was a good feeling when I finally saw what I believe Hughes wanted me to see.

My Philosophy of Teaching Teaching is a daunting task that I do not intend to take lightly. Becoming a teacher has been a dream of mine for several years. I always knew that teaching would be the career for me, especially when I began working in the school system as a substitute secretary. I loved working in the school environment; coming in contact with children everyday made me realize how much I would enjoy teaching a classroom full of students. Teachers play such an important role in a child’s life, sometimes being their only source of encouragement and support. As a teacher, I want to know my students – their personality, learning style, and academic level, so I can meet their needs and create the best learning environment possible. The definition of the word â€Å"educate† is: â€Å"to develop the faculties and powers of (a person) by instruction or schooling.† I believe the key word in this definition is â€Å"power.† As a teacher, I must find several ways to unleash that power in a child’s mind; I must motivate, inspire, and encourage my students. â€Å"Education is not filling a bucket, but lighting a fire.† (William B. Yeats) The purpose of education is to teach the basics of knowledge and to challenge each individual to learn. The realization that I will have the power to make a difference in a child’s life is sometimes overwhelming. This remarkable fact gives me a stronger purpose – to be a positive role model for my students. Being an effective teacher is truly an awesome responsibility.
